In 2019, the Ministry of Housing and Urban-Rural Development issued a Notice on Supporting the Development of Private Construction Enterprises, reiterating that private construction enterprises should not be required to register and set up independent subsidiaries or branches in the region.
 
It has been a long time since construction enterprises were required to set up sub-companies for trans-regional contracting business. Some local governments have forced construction companies to set up local branches or subsidiaries in order to keep more tax sources in the area. In fact, according to the current regulations, construction projects in other places need to pay VAT in advance at the rate of 2% or 3%, and enterprise income tax in advance at the rate of 0.2% of actual income, which has played a role in balancing the financial interests of various regions. In addition, the enterprise income tax project profits of the establishment of branch companies cannot be paid locally, but adopt the methods of unified calculation, hierarchical management, local pre-payment, summary liquidation and financial adjustment to calculate the enterprise income tax. Therefore, even if a branch company is set up, if the parent company loses money or the weight of various factors of the project is low, there will be no local corporate income tax or little tax.
 
In short, the establishment of a branch or subsidiary company will greatly increase the accounting cost of the enterprise, limiting the fair competition of construction enterprises. It is beneficial to build a good construction market environment, promote the free flow of enterprises, and promote the sustainable and healthy development of the construction industry to solve the problem of establishing sub-companies for trans-regional contracting business.

For construction enterprises in arrears of construction workers' wages, the proportion of construction workers' wage deposit payment shall be increased in accordance with regulations, and relevant bad behaviors shall be recorded in enterprise or individual credit files. In Jiangxi province, the real-name system is taken as an important measure to guarantee the payment of migrant workers' wages and standardize the system of construction labor and employment, basically realizing the implementation of the real-name system for construction workers in all newly started housing construction and municipal engineering projects in the province. In Qinghai, the real-name information management system for construction workers has been implemented for housing construction and municipal infrastructure projects that require construction permits within the administrative region. All construction units, construction enterprises (including professional subcontracting and labor operation enterprises, etc.), project management personnel of supervision units and construction workers who enter the construction site shall be included in the real-name management category of construction workers.
 
At present, the real-name management system has basically covered the whole country, strengthened the supervision and raised the threshold. In the future, there will be any "dirty tricks", the site will appear "extra personnel", the Internet will be able to give out a "warning". This will standardize the labor order of the construction market, lead migrant workers to gradually transform into modern skilled workers, and improve the competitiveness and vitality of construction enterprises.
 
Inovate regulatory models
